1. Acceptance of Terms

By accessing or using the Daily Tables mobile application (“App”) you accept and agree to be bound by these Terms and Conditions (“Terms”). Between you (the “User”) and Daily Tables (“Daily Tables,” “we,” “us,” or “our”), these Terms form a binding contract. If you do not agree, you must not access or use the App. On behalf of themselves and their children, parents/guardians (“Parents”) who create accounts for minors (“Children”) agree to aforementioned terms.

By accessing or using the Daily Tables mobile application (“App”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you (the “User”) and [Company Name] (“Daily Tables,” “we,” “us,” or “our”). If you do not agree to these Terms, do not use the App. Parents/guardians (“Parents”) creating accounts for minors (“Children”) accept these Terms on behalf of themselves and their Children.

2. Definitions

  • “App”: The Daily Tables mobile application and associated services.
  • “Child Profile”: A sub-account managed by a Parent for a minor.
  • Parent Account“: A Parent or guardian account with administrative privileges.
  • “Personal Data”: Information identifying a natural person under the UK GDPR and Data Protection Act 2018.

3. Account Registration & Management

Parent Accounts

  • Parents must provide a valid email address, create a password, and verify their identity via email confirmation.
  • Parents may link multiple Parent Account to jointly manage Child Profiles.
  • Parents are solely responsible for:
    • Setting educational goals, rewards, and monitoring progress.
    • Ensuring rewards (e.g., cash, gifts) are fulfilled.
    • Maintaining the security of login credentials.

Child Profiles

  • Child Profiles require the Child’s first name, last name, and date of birth (DOB) to tailor content to age/ability.
  • Children cannot independently create accounts or modify settings.

Account Deletion

  • Parents may delete Child Profiles or Parent Account at any time via the App.
  • All associated data will be permanently erased from active systems within 30 days. Backups are anonymized or deleted within 90 days.

4. Subscription & Payments

Free Trial & Renewal

  • New users receive a 14-day free trial. Payment details are required upfront but not charged until the trial ends.
  • Subscriptions auto-renew unless canceled 24 hours before the renewal date.

Pricing

  • Monthly: £1.49/month
  • Yearly: £12.99/year (30% savings)
  • Taxes may apply. Refunds are not provided for partial periods.

Cancellation

  • Cancel via your device’s app store (e.g., Apple App Store, Google Play).

5. Data Protection & Privacy (UK GDPR/DPA 2018 Compliance)

Lawful Basis for Processing

  • We process Personal Data under parental consent (Article 6(1)(a) UK GDPR) and to fulfill contractual obligations (Article 6(1)(b)).

Data Collection

  • From Parents: Email, payment details, device type/IP address (for security).
  • From Children: First name, last name, DOB (to assign age-appropriate content).

Parental Consent

  • Consent is obtained via email verification and maintained in audit logs.
  • Parents may withdraw consent by deleting accounts, which terminates all data processing.

Third-Party Processors

  • We use Firebase (analytics), AWS (hosting), and Google Play Console (distribution). These processors:
    • Operate under strict Data Processing Agreements (DPAs).
    • Do not use data for independent purposes.
    • Comply with UK GDPR transfer mechanisms (e.g., International Data Transfer Agreements for US-based services).

Data Security

  • Technical Measures: AES-256 encryption, role-based access controls, annual penetration testing.
  • Organizational Measures: Staff training, confidentiality agreements, and access limited to authorized personnel.

Data Subject Rights

Parents may:

  • Access all Child Data via the App.
  • Rectify inaccuracies in real-time.
  • Request erasure via account deletion.
  • Object to processing (email [Support Address]).
  • Lodge complaints with the UK Information Commissioner’s Office (ICO).

Breach Notification

  • We will notify the ICO and affected Users within 72 hours of a confirmed data breach.

6. Rewards & Financial Terms

  • Cash Rewards: Tracked in a “Money Pot” and withdrawable via Parent-approved methods (e.g., bank transfer). Daily Tables is not responsible for transaction fees or disputes.
  • Non-Cash Rewards: Parents are solely responsible for fulfillment.
  • Fraud Prevention: We reserve the right to suspend accounts for suspicious reward claims.

7. Prohibited Conduct

Users must not:

  • Upload offensive/illegal content.
  • Reverse-engineer the App.
  • Use automated tools to manipulate worksheets or rewards.

8. Intellectual Property

  • All worksheets, logos, and content are owned by Daily Tables or licensors.
  • Users receive a limited, non-exclusive license to access the App for personal use.

9. Limitation of Liability

  • Daily Tables is not liable for:
    • Unfulfilled rewards or Parent-Child disputes.
    • Indirect damages (e.g., loss of profits).
    • Downtime caused by third-party services (AWS, Google Play).
  • Liability is capped at the total fees paid by the User in the preceding 12 months.

10. Termination

  • We may terminate accounts for material breaches (e.g., fraud, abuse).
  • Users will receive 14 days’ notice (except for egregious violations).

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of England and Wales.
  • Disputes will be resolved in UK courts or via arbitration (User’s choice).

12. Amendments

  • We will notify Users of material changes via email or in-App alerts 30 days in advance.
  • Continued use constitutes acceptance.
